Penalties for Forgery in Chicago
n 2012, the state of Illinois broadened the definition for forgery, making it easier for police and investigators to charge and convict individuals with the crime. Under the previous law, a false document was illegal if it appeared to be created by another person. The new law states that as long as the document is false and has the ability to deceive another person, charges can be filed. As a Class 3 felony, a forgery conviction can result in a fine of up to $25,000, up to 5 years in prison, and court-ordered restitution, or repayment to the victim for the money he or she lost. While the fine is capped at $25,000, restitution is unlimited, which means individuals convicted of forgery could repay their victims for many years. Courts also may not agree with that individual’s idea of a reasonable monthly restitution amount, which could result in severe financial problems for a person convicted of forgery.
